TERMS OF USE
Kathy White Yoga provides a personalized yoga service for visitors and members to the website to access classes, courses, challenges, programs and articles delivered over the internet to connected computers and other devices. Kathy White Yoga also offers live zoom classes, in person studio classes, retreats, and health, yoga and mindset coaching programs that have a mix of content delivered via the website, zoom or other platforms for live, recorded or in person interactions.
Limitation of Liability
Kathy White Yoga will not be held responsible for any errors in the content on the website.
Anyone using the instructional videos, following a program or learning from the material on this site is doing so entirely of their own free will. Anyone who undertakes any yoga or health program is required to obtain medical advice, or is self declaring their health and ability to participate safely before doing so. Kathy White Yoga will not be held responsible for any accident, injury or illness, mental, physical or emotional, to any person while they are partaking in any free or paid yoga or health class or program offered here on this website.
Disclaimers of Warranties and Limitations on Liability
- The Kathy White Yoga service and all content or other features or functionalities associated with this service, are provided "as is" and "as available" with all faults and without warranty of any kind. Kathy White Yoga does not guarantee, represent, or warrant that your use of the service will be uninterrupted or error-free. Kathy White Yoga specifically disclaims liability for the use of applications, devices, and software (including their continuing compatibility with the service).
- To the extent permissible under applicable laws, in no event shall Kathy White Yoga be liable to you for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever to you.
- Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. therefore, some of the above limitations in this section may not apply to you.
Nothing in these terms of use shall affect any non-waivable statutory rights that apply to you.
Membership
Free Trial
You may be given a free membership to Kathy White Yoga to access a limited number of products, if you wish to upgrade this free membership to a paid subscription, you will get access to the next level of products, classes and recordings.
Paid Membership
Your Kathy White Yoga membership will continue month-to-month and automatically renew until terminated. To use the service you must have Internet access and a device connected to the internet and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time and which may include payment through your account with a third party. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fees to your Payment Method (see "Cancellation" below).
Billing and Cancellation
Billing Cycle. The membership fee for the Kathy White Yoga service any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged annually to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your membership until your membership is cancelled. Membership fees are fully earned upon payment. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.
Payment Methods. To use the Kathy White Yogaservice you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.
Cancellation. You can cancel your Kathy White Yoga membership at any time, and you will continue to have access to the service through the end of your monthly billing period. We do not provide refunds or credits for any partial-month membership periods or unwatched content. To cancel, login to your account. If you cancel your membership, your account will automatically close at the end of your current billing period.
Changes to the Price and Subscription Plans. Kathy White Yoga reserves the right to change subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes or changes to your subscription plan will take effect following an electronic notice to you.
No Refunds. Payments are non-refundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
Passwords and Account Access
When you create a Kathy White Yoga membership account, you are the "Account Owner" and have access and control over the account. To maintain control over the account and prevent anyone from accessing the account (which could include information on viewing history for the account), the Account Owner should maintain control and not reveal the password or details of the Payment Method associated to the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We reserve the right to terminate your account or place your account on hold in order to protect you from identity theft or other fraudulent activity.
The Kathy White Yoga Service
- You must be 18 years of age, or the age of majority in your province, territory or country, to become a member of the Kathy White Yoga service. Individuals under the age of 18, or applicable age of majority, may utilize the service only with the involvement of a parent or legal guardian, under such person's account and otherwise subject to these Terms of Use.
- The Kathy White Yoga service and any content viewed through our service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your membership, we grant you a limited, non-exclusive, non-transferable right to access to the material in the membership area and no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
- You may view Kathy White Yoga content primarily within the country in which you have established your account. We may periodically check the IP address logging into your account and if there is unusual activity, we reserve the right to investigate. We will close your account if you have shared your login details with others outside your household.
- You agree to use the Kathy White Yoga service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized in these Terms of Use, you agree not to archive, download, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the Kathy White Yoga service. You also agree not to circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the service; use any robot, spider, scraper or other automated means to access the Kathy White Yoga service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Kathy White Yoga service; insert any code or product or manipulate the content of the Kathy White Yoga service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
- The quality of the display of the Kathy White Yoga content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. Please check with your Internet provider for information on possible Internet data usage charges. Kathy White Yoga makes no representations or warranties about the quality of your watching experience on your display. The time it takes to begin watching content show will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your ready device.
- Any software for authorized streaming and viewing of content from Kathy White Yoga may vary by device and medium, and functionalities may also differ between devices. If you do not accept the foregoing terms, do not use the service.
Kathy White Yoga is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to us ("Feedback"), including responses to application or through postings on the website, facebook and other social media platforms in perpetuity without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Kathy White Yoga service. In addition, you agree not to enforce any "moral rights" in and to the feedback, to the extent permitted by applicable law.
Communication Preferences.
Kathy White Yoga will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration. You agree that any notices, agreements, disclosures or other communications that are sent to you electronically will satisfy any legal communication requirements, including that such communications be in writing, and you will be responsible for updating your email details (should they change) on your account in order to receive such communication.
Changes to Terms of Use
Kathy White Yoga may, from time to time, change these Terms of Use also called Terms and Conditions. Such revisions shall be effective immediately; provided however, for existing members, such revisions shall, unless otherwise stated, be effective 30 days after posting.
Permitted Use
Users are not permitted to access and use any content from Kathy White Yoga website (i.e., written text, graphics, data, images, logos, video clips, etc.) other than for the purposes of study when following their paid for program. All use of videos, text, documents etc. is limited solely to the named person who purchased access to such material. And access, use of that material is limited to the time in the program. Any unlawful downloading, distribution, re-sharing or re-purposing of the material is prohibited by law. Stock Images on this site from Depositphotos.com are licenced for use ONLY to Kathy White Yoga who has paid the appropriate fee for useage.
Promotions / Competitions and or Prize Draws
Any competition, prize draw will be conducted and promoted by Kathy White Yoga www.kathywhiteyoga.com unless otherwise advertised in the promotional website pages and social media posts.
Prize Draw Terms and Conditions:
1. No purchase is necessary to enter any prize draw
2. Prize draws and competions are open to UK, USA, Ireland, Canada residents aged 18 years or over unless otherwise posted.
3. Entries must be received by the draw date marked on the facebook page, website page, form page and other social media posts. Kathy White Yoga accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach or be entered into the draw or competition.
4. Only one entry allowed per person. No entrant may win more than one prize if there are multiple prizes.
5. To enter fill in your details as directed in the form hosted on the appropriate page for the draw you are entering.
6. All correctly completed entries will be entered into a prize draw which will take place on the draw date marked on the website page and or facebook page, email correspondance and other social media posts.
7. The prize for the winners will be clearly noted on the pages promoting the draw.
8. The prize is subject to availability. In the event of unforeseen circumstances, Kathy White Yoga reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion/ competition or prize draw without notice. No correspondence will be entered into.
9. The winners will be notified via email. The winner must claim their prize within 48 hours of Kathy White Yoga sending notification. If the prize is unclaimed after this time, it will lapse and Kathy White Yoga reserves the right to offer the unclaimed prize to a substitute
winner, or keep for a subsequent prize draw in accordance with these rules.
10. To obtain details of the winner please email support@kathywhiteyoga.com stating the name of the prize draw in the subject heading within 4 weeks after the closing date.
11. Kathy White Yoga will use any data submitted by entrants only for the purposes of running the prize draw, unless otherwise stated in the entry details. By entering this prize draw, all entrants consent to the use of their personal data by Kathy White Yoga for the
purposes of the administration of this competition, promotion or prize draw and any other purposes to which the entrant has consented.
12. This Promotion is in no way sponsored, endorsed or administered by or associated with Facebook. You acknowledge that all information and material that you submit to enter this promotion/ prize draw and or competition is submitted to Kathy White Yoga and not Facebook or other social media platforms and you agree that Facebook or other social media platforms shall not be liable to you in any way in respect of this Promotion.
13. The winners agree to take part in any reasonable post event publicity and to the use of their names and photographs in such publicity.
14. Kathy White Yoga may disqualify any entrant whose entry does not comply with these terms and conditions (in Kathy White Yoga's sole opinion) or who, in Kathy White Yoga's sole determination, has acted in a manner that is fraudulent, dishonest or unjust to other entrants including, without limitation, tampering with the operation of the prize draw, manipulating or rigging votes, hacking, deceiving, cheating or by harassing or threatening other entrants or a representative of Kathy White Yoga.
15. By entering the prize draw each entrant agrees to be bound by these terms and conditions.
